Creators retain ownership of all uploaded work until deliverables are approved, payment is released, and rights transfer is complete. Anything before that moment is review-only access.
Ownership of submitted work
You retain full ownership of every video, image, audio file, draft, revision, and supporting asset you upload to a MODA workroom. That ownership persists across submission rounds, revision cycles, brand review, and approval — and is not modified by upload, by review, or by approval alone.
Ownership transitions to a licensed-use state only when all three of the following are true for the relevant deliverable:
- 01The deliverable has been formally approved inside the MODA workroom.
- 02The associated workroom payment has been released to you.
- 03MODA's rights transfer state for the deliverable is active.
Until those three conditions are met, the brand's access is limited to in-platform review.
Pre-release review access
Brands you are working with receive structured review access while deliverables are in production. This access exists so brands can evaluate whether work meets the brief, request revisions, and formally approve the final deliverable inside the workroom.
Review access is not a license. It does not authorize commercial use, redistribution, or external publication of any submission — including approved submissions whose payment has not yet been released.
Unauthorized usage prohibition
Prior to payment release and rights transfer, brands and brand team members may not:
- 01Commercially use, advertise with, or monetize any submission.
- 02Reproduce, edit, remix, or derive new content from a submission.
- 03Redistribute or share submissions with parties outside the workroom.
- 04Download master files, source files, or original-quality assets.
- 05Screen-record, screen-capture, or re-encode submissions for any usage purpose.
- 06Publish submissions to any external platform, paid placement, or owned channel.
Suspected violations are investigated by the MODA trust and moderation team and may result in payout protections in your favor, campaign-level restrictions, account suspension of the offending party, or further action under our platform rules.
When rights transfer activates
Rights transfer is automatic. It activates the moment the workroom confirms that all required deliverables have been approved and the associated payment has been released to you. From that point forward:
- 01Approved deliverables become licensed for the campaign use described in the original brief.
- 02Master-quality downloads unlock for the brand inside the workroom.
- 03Future use beyond the original campaign scope requires a separate agreement with you.
Rights transfer applies only to deliverables that were both approved and paid for. Drafts, rejected submissions, and unused revision rounds remain entirely yours.
MODA's role · escrow and orchestration
MODA is the platform intermediary between you and the brand. We do not commission work, employ creators, or claim ownership of any submission. We operate the surface that protects both sides:
- 01We hold the brand's payment in escrow before any deliverable can be submitted.
- 02We provide the workroom in which deliverables are uploaded, reviewed, revised, and approved.
- 03We orchestrate the release of your payout once approval is reached.
- 04We enforce the rights transfer transition that activates licensed brand use.
Creator protection · why this exists
MODA replaces the opaque chain of agency emails, off-platform payments, and verbal usage rights that have historically defined creator work. The combination of escrow, structured workrooms, and release-gated rights transfer is designed to give you operational and financial protection on every campaign you accept.
You shouldn't have to chase payment, prove what you delivered, or discover your work in a campaign you weren't paid for. MODA is built so you don't have to.
Changes to these terms
MODA may update these terms to reflect new platform capabilities, regulatory changes, or operational improvements. Material changes will be announced inside the platform with reasonable advance notice, and the effective date above will reflect the most recent revision.
